yes thats what they do, untill its time for his court martial. Untill they are ready with all the paper work and stuff, they have to let him go. Its just like the civilian Law, you pay your BAIL and go on with life normally untill your court date and if your convicted you do your time. In the service you dont pay for bail they just decide if you should be released or not UNTILL the time for his trial. So in other words yes "They just let him go... cuz that's what they do?"

Christ, if you're gunna argue anything, it should be that he was not being treated like other prisoners. With his lawyer, he had to sue to get released because, traditionally, the crimes he is charged with (2 counts of failure to obey general orders) don't call for confinement while waiting for trial.

again, get fucking real. the issue was espionage with al qaeda/syrian links (at least i remember suggestions that some of the people in this investigation had links to general espionage and syria was mentioned - i.e. spies).
