VUG and Sony sued by mom over epileptic seizure on infant from playing game

An infant suffered a seizure by playing Spyro: Enter the Dragonfly (2002).

On behalf of her child, the woman is seeking damages "for such fair and reasonable amount as may be awarded by a jury of his peers," along with whatever other relief the court may deem just and proper. Earlier this week, Sony requested that the woman specify the total amount of damages she's seeking.

Isn't there a warning on the back of all games saying that 'This game contains flashing colors and may cause epileptic seizures'?

there is also a statement which says some terms and conditions may not apply due to local laws forbidding such terms.

if you're a mother with a kid that gets seizures.. don't you prescreen the games the kid plays for warnings about flashing colors?

Look at it this way. As far as you know, your kid is fine. All of a sudden he has a seizure. Several thousands of dollars worth of tests later, you find out he has an underlying condition and a medical record that will keep him from getting insurance coverage for it for the rest of his life. Your choice at that point is to utterly ruin your family's finances or sue Sony.

Please note that I personally wouldn't choose to sue, but I can understand why she would.

seizures are common in kids.. most people tend to grow out of them.. are you sure that it'll ruin insurance coverage for the rest of your life? plus the kid would be covered under the parent's insurance until well after he should have outgrown the condition

What the mother fuck is an infant doing playing video games? Do infants even have the necessary motor skills to hold and operate a controller?

haha this story reminded me of the younger brother of somebody that I knew, the kid would have seizures all the time while playing video games, but he loved playing them so parents just let him play.
