When a TK on a server wants to evade kicks (at least in T1) he can drop/rejoin the server whenever the vote to kick occurs. This is annoying.
The kick function should assume a player has been voted off the server if he drops while a vote to kick is occuring (applies the temporary ban from the server). He could be given a warning before he drops to prevent people from exploiting the function against players who are coming right back (i.e. demo dropping).
