Nah we agree that he's going to jail for a crime committed during an investigation and not what he was being investigated for. Something he should not do, a punishment he deserves, that does absolutely nothing to justify the original investigation or support the initial claim.

You're trapping yourself with this one. You're admitting you don't believe a process crime is a big deal in an attempt to declare hypocrisy. Do you believe Bill Clinton lying under oath (to congress) makes him guilty of sexually harassing Paula Jones? Does it make him guilty of any of the 40 crimes people went to jail for over Whitewater? Or Travelgate? Or the misuse of FBI files?
Or do you believe, rightly, that it was a "get him however you can" scenario?
The question was, why would he lie? Whose ass was he trying to cover other than his own? Was he acting as the "access point" to Wikileaks (Steve Bannon's words) because he himself was running for President?
