There is a case recently where an employee was being discharged and went through and deleted all of his email and docs before leaving. He was charged with destruction of company property. I would imagine the same case would hold especially for the government with a higher penalty due to the nature of those emails. No different than the feds raid your house and find you torching paper you are wanting to hide.

Electronic laws have slowly been coming around.

The point is that you need to be able to prove this, find the people willing to flip on her, and also be able to determine that she had intentions of mishandling "classified information". You can't even get past the first step of proving she had intentions of mishandling "classified information" because the information only became classified years after its existence.

Your arguments for locking her up much like the investigation have gone nowhere. It's embarrassing.

None of her emails were deemed to be classified in nature until years later. Explain how anyone would know how to predict a re-classification well into the future.

Ahhh, yes, the open source email/coookie deletion tool. Why would somebody with that kinda money use free software instead of buying something legitimate and powerful?

The reason why your case falls apart and is flimsy is because these actions were clearly amateurish. A truly sinister act by a competent person would have had this planned out beforehand and they probably would've destroyed their servers and phones in a more competent manner.
