I'm just suggesting. It's certainly a way of looking at it. When they put the cuffs on him, he ran. Didn't try to fight them, he was trying to escape. Not suggesting that's acceptable or anything, but he was in "flight" mode, not "fight". He gets tackled, wrestled to the ground and they try to restrain him. All normal. They hit him with the taser (and yeah, it looks like the "deployable" firing pin kinda thing, but the cop quite clearly is pressing it into his leg.. does they have some kind of 'secondary' fire mode where you can just energise the barbs? I imagine that would make it a lot more re-usable?).. He jolts, and reaches down (probably without even being able to see what he's reaching at) and winds up with the taser in his hand.
I'm not at all trying to excuse what he did. I'm also though, not trying to excuse what the cops did. It was a ****up, and a guy wound up dead. Given the standards that have been established in the US with trigger-happy ****ing everyone, it's understandable that the cops shot. Should that be the case? I think there has to be a better way to do it. I think it's harsh that the cop wound up on murder charges, when as you can see from the sorts of reactions in here, that people pretty much have come to expect it, even if it seems like it's actually unlawful (ie: that the victim wasn't an imminent threat to life).

An assault is up to the person being touched. If someone touched another person that did not want to be touched, it is considered an assault. We see this **** all the time in the media and especially during protests. "Don't you dare put your hands on me!! HE TOUCHED ME! He just assaulted me!"
But now that a female inappropriately touched a male, suddenly there are exceptions to the rule that only apply to males touching females or other males.
That taser he grabbed was literally just being jammed into his leg, he grabbed at it and wrestled it away as it was being employed on him. It's possible to argue that he was simply trying to disarm the guy that was attacking him, that it was only after he'd done so, that it twigged he had a taser in his hand and turned it back against his attackers. I'd think a defence lawyer arguing his case could put that forward quite convincingly. That he wasn't intending to 'steal a weapon', just to stop the attack against himself, and given the absolute lack of any sort of fight in the lead-up, that his first reaction was to run, it would be hard to show he had any real intention of causing anyone any harm.
