Anyways, this is my last post here. Going to court over a forum invasion is the stupidest thing I've ever heard, but I wanted to show that if you took that route, it wasn't an open and shut case, especially considering all that tribalwar has done or threatened to do.
 
Let's look at it this way.

A band of people gather in one place, behind closed doors, to discuss the assassination of a public figure. They buy all the materials they need, knives, rope, what have you. Then one of them comes over to the public figure's house, and just drops off a knife.

They don't go any further.

Do you think they won't be found guilty if what they said behind closed doors was made public? Do you think they'll be able to get away with saying "it was just a joke between friends"?

This is the Internet, making threads, and giving explicit instructions on how to go about mass calling and mass mailing a certain person in particular, is illegal. The intent is there.

Yeah, except take out the part about an assassination, replace the closed doors with an internet thread, take out the buying of materials, replace the knife with a picture of a guy ripping his ass open, and there you have it.

same thing goes here. a threat was made and it put a response in colosus...maybe even tramatized him a little and now he is scared to walk to the store now. maybe he checks his whole car for a man that is there to murder him before he drives anywhere - maybe he calls his family every hour to make sure they are okay..

thats all he has to say to win the case.

doesnt matter about anything else. just about what is happening.

my dad won a case about this with this old guy who bought a defunct air filter. said it caused some sorts of multiple damages to him (forgot exactly what) but won the case and the guy got awarded a couple million.

but all in all any kind of death threat is against the law. it doesnt even matter if youre joking. it just matters what the RECEIVING end takes it to be.

Going to court over someone making harrassing phone calls to your residence seems to be a perfectly logical solution to me.

Colosus and his family were threatned. That is a federal offence, it has no relevance as to any forum invasion.

Ok, now it makes a little more sense. I don't think nSpec would be in any trouble for simply having the picture, since it's in the public domain and he got it off the Internet, or even for delivering it to the guy in LA, unless there is some wierd law out there in California that I don't know about. The guy who got the death threats should probably call the police and make a report.

Bottom line, as far as I know, the only guy who can get arrested is the one called your site admin and made the death threats.
