It could be argued that nspectre's appearance at Daspin's house and Smack's phone call to Daspin are both proof positive that these threats were going to be carried out.

I was here since the beginning of this whole stupid escapade, get YOUR facts straight. You're just another dumb sheep being taken along for the ride in a whirlwind of lies. There was no threat of murder to the webmaster, I can guarantee this. Probably there was implied violence, but if you're gonna take Daspin up on harassment, he can countersue you.

Your sense of reality is seriously fucked if you think you can take the moral high ground after threatening various members of their board with harassment. Not only that, you threatened to firebomb his house, while he was online, in the same thread where his address was posted.

I don't know about legal precedents, but that seems like a pretty open and closed case to me, dumbass.

In short, you took this to RL, Daspin took it further, and you can either go all the way or back down. Just a warning that if you try and go all the way, the probability is that you will lose.

Not to mention what will happen if f4$ drags up other similar incidents of you harassing other forum members in the past.

You cannot consider tribalwar as a whole entity because we are not all responsible for this. Therefore, you cannot consider these few members as one entity either

nspectre's appearance at daspin's house was harmless and could not be proven in relation to this.

Smack's phone call was obviously to the wrong place, and even if it wasn't, through this phone call there was no indication as to the intention of the conversation...

If somebody went out and purchaed materials used to cherrybomb or what not a house, then yes, you could attempt to prosecute because the guilty mind (mens rea) was there... However, nobody did. Furthermore, IIRC the conversation was not done infront of him, and under oath, I doubt he would be able to say without lying that he was afraid for his life

On the other hand. He calls colossus, forget that, he calls colossus's FAMILY and threatens them to the extent that they contacted him and he acted and shut down the forum.

Stop trying to support their cause.

I doubt it. Tribalwar as owned and operated by Colosus is not responsible for the actions of the people on the forums. If you want to sue, you could probably sue the individuals responsible, but you couldn't sue Colosus OR take the site down.

Meanwhile, Col could and SHOULD sue Jeremy not just for harassment, but for threatening bodily harm in a recorded telephone call. Not only is that going waay beyond the line, but you'll find that we have a lot more people here, some of whom are VERY protective of this site and it's operators.

This whole incident is retarded as hell. First off, f4$ has jack shit on col legally. They might have some shit on nspectre but just because nspectre visits TW doesn't make him and col bound at the hip. Now, If col was actually threatened over the phone then that is truly fucked up. Col should do whatever is needed to have the faggot unished.

A band of people gather in one place, behind closed doors, to discuss the assassination of a public figure. They buy all the materials they need, knives, rope, what have you. Then one of them comes over to the public figure's house, and just drops off a knife.

They don't go any further.

Do you think they won't be found guilty if what they said behind closed doors was made public? Do you think they'll be able to get away with saying "it was just a joke between friends"?

This is the Internet, making threads, and giving explicit instructions on how to go about mass calling and mass mailing a certain person in particular, is illegal. The intent is there.

Colosus has never been dishonest with us before regarding his role as the administrator of this forum. Until shown otherwise we can be comfortable in beleiving he's 100% truthful.

Furtheremore, there is an act, I can't remember where or wha it is now, but the webmaster of a website can't be held repsonsible for the memebers of the forums. Furthermore, he cannot be held responsible for the content posted on the forums for as long as there has been a proper disclamier posted.

Here's the difference
for the elements of crime to occure, actus reus and mens rea must exist
actus reus is the guilty act and mens rea is the guilty mind
in your case, the buying of the instruments can consitute the guilty mind.

The actus reus is when the member left his house to go to the other house, no other actus reus need to be proven

ok... a friend of mine is taking the bar in a month or so.. this is what she said about the whole thing.

Definitely, the guys who made the death threats could get in quite a bit of trouble, if the threats can be taken seriously. As for delivering a letter to someone's house, there's nothing per se wrong with that, and from what you said, he was escorted onto the property, so there can't be any trespassing issues. But, you'll have to explain the problem with the picture to me again. By the way, that's disgusting!
