Sojourn 06-18-2003, 04:39 PM No, there's no obscure law in California that would come into play. But I don't even know why people are arguing this crap anymore. You could argue harassment, maybe. There could possibly be a fine, a warning, and that would be the end of it.
CrazyLEG 06-18-2003, 04:40 PM Bottom line, as far as I know, the only guy who can get arrested is the one called your site admin and made the death threats.
Yep, Mr. RL Goatse himself.
Now, does Col have it within himself to persue legal action?
FalseMyrmidon 06-18-2003, 04:40 PM charade is stupid
i think i read somewhere that he went to community college of law?
Jazmine 06-18-2003, 04:51 PM Is Charade a friend of Jeremy's? I see he is new here, just curious.
MST3K-rules 06-18-2003, 04:52 PM I just wish Colosus had written this instead of the they win thing:
FAKE QUOTE:
Colosus
I'm shutting the forum down for a few hours so that everyone can cool down. This has all gone too far; hand-delivering pictures and making hostile phonecalls is out of line.
f4$: Stop calling me or I will notify the police. I'm sorry about the goatse but I can't control what idiots on my forum do any more than you can control the people on your forum.
Oktane 06-18-2003, 05:04 PM I know where charade lives. I'm going to pay him a visit tonight and fucking smash his fucking fuck.
Sue me, charade. No, seriously.
Oktane 06-18-2003, 05:07 PM blahblahblahbut I wanted to show that if you took that route, it wasn't an open and shut case, especially considering all that tribalwar has done or threatened to do.
well you didnt show us that, sorry. all you showed us is that you're a fucking moron who is talking out his ass.
DruMAX 06-18-2003, 05:10 PM Most every state has laws governing the distribution and possesion of obscene material, this is just one of the many obscenity laws, some are tougher some are looser but I am pretty sure that delivering unsolicited obscene material to a person is illegal or could be bent that way. Most laws do not qualify how it is distributed.
76-10-1204. Distributing pornographic material.
(1) A person is guilty of distributing pornographic material when he knowingly:
(a) sends or brings any pornographic material into the state with intent to distribute or exhibit it to others;
(b) prepares, publishes, prints, or possesses any pornographic material with intent to distribute or exhibit it to others;(c) distributes or offers to distribute, exhibits or offers to exhibit any pornographic material to others unsolicited;
(d) writes, creates, or solicits the publication or advertising of pornographic material;
(e) promotes the distribution or exhibition of material he represents to be pornographic; or
(f) presents or directs a pornographic performance in any public place or any place exposed to public view or participates in that portion of the performance which makes it pornographic.
-Each separate offense under this section is a class A misdemeanor punishable by:
-a minimum mandatory fine of not less than $100 plus $10 for each article exhibited up to the maximum allowed by law; and
-incarceration, without suspension of sentence in any way, for a term of not less than seven days, notwithstanding any provisions of Section 77-18-1.
-If a defendant has already been convicted once under this section, each separate further offense is a third degree felony punishable by a minimum mandatory fine of not less than $1,000 plus $10 for each article exhibited up to the maximum allowed by law and by incarceration, without suspension of sentence in any way, for a term of not less than 30 days. This subsection supersedes Section 77-18-1.
FalseMyrmidon 06-18-2003, 05:14 PM so he could get $100 fine?
don't you get a $500 fine for littering?

So if nspectre gets a $100 fine for "distributing pornographic material", I demand that Jeremy gets jail time.
Hell, I'll pay half that fine out of my own pocket. nspectre deserves mad props.
flexxx 06-18-2003, 05:19 PM Anyways, this is my last post here. Going to court over a forum invasion is the stupidest thing I've ever heard, but I wanted to show that if you took that route, it wasn't an open and shut case, especially considering all that tribalwar has done or threatened to do.
A final thought from me to you: Fuck off and Die, you were owned, you suck, please shoot yourself.
DruMAX 06-18-2003, 05:23 PM I agree, it was fucking classic...
I would laugh it off if it were me...but if I had kids and a family, I wouldnt laugh it off having some guy stalking around my house leaving packages.
Aurora 06-18-2003, 05:29 PM 76-10-1204. Distributing pornographic material.
http://dictionary.reference.com/search?q=pornography
goatse could be considered a form of art.
but then under that definition it would be illegal to send him a book about hitler... (third definition which says lurid is a meaning to pornographic)
DruMAX 06-18-2003, 05:34 PM yeah, I like dictionary.com...now go link it to the law makers because they classify porngraphy as obscene material and I dont think anyone is going think goatse is art...I think anyone faced with goatse will label it obscene material.
Musashi 06-18-2003, 05:37 PM pornography. n. Sexually explicit pictures, writing, or other material whose primary purpose is to cause sexual arousal.
Goatse is not supposed to cause arousal. VGE

(sigh) This argument needs to be ended now. The law defines obscene material as that, which to the average person, depicts or describes sexual conduct in a patently offensive manner. Goatse would not be considered a form of art, because it lacks any serious artistic value.
I don't really give a shit about this whole thing, and I had a couple of laughs over it, but trying to claim that it could be a form of art is rather ridiculous.
Hyperion 06-18-2003, 05:37 PM lmao

Expensive sperm
Igor Lehnberg, a Swedish man who was friends with a lesbian couple, wanted to help the ladies have children so he donated sperm for artificial insemination and soon the women had three kids. After breaking up with her significant other, however, the mother of the children filed a lawsuit against Lehnberg for child support -- and won. In early 2002, the Swedish court ruled that the man was undeniably the biological father and was therefore condemned to pay a monthly allowance of approximately $280 US.
what if ridiculous works :P
Sojourn 06-18-2003, 05:45 PM what if ridiculous works :P
I'll admit, that is ridiculous. And funny. But it is not relevant to this argument.
It doesn't really matter one way or another. He would get hit with a small fine. Hardly a big cause for concern. The judge might even get a laugh out of it.
FalseMyrmidon 06-18-2003, 05:45 PM what if ridiculous works :P
wow, that is the stupidest thing i have ever seen
